1. GENERAL SALES CONDITIONS
1.1 The customer may terminate the contract for the purchase of the desired product by
making direct access to the Web site www.forbicipercapellielio.it, carefully following
all indications and procedures.
1.2 These general sales conditions must be examined by the customer before completion of the purchase process. The submission of the confirmation order, therefore, implies full knowledge and acceptance of these conditions.
1.3 The customer, by sending electronic confirmation of the purchase order, unconditionally accepts and undertakes to observe the general sales conditions, including the payment conditions described below, and declares having read and accepted all the provided information.
2. SALES PRICES AND PURCHASING CONDITIONS
2.1 For shipment to Italy, all the sales prices of the products shown and indicated on the Web site www.forbicipercapellielio.it are inclusive of VAT (Italian value added tax).
According to the flat-rate scheme of the company Toma Alberto, in compliance with article 1 sub-sections 54 to 89 of Law no. 190/2014, for shipments to the European Union (Italy
excluded), all the sales prices of the products shown and indicated on the Web site
www.forbicipercapellielio.it are VAT exempt.
2.2 The customer can pay for the ordered goods using the payment methods indicated online at the time of purchase. Payment can be made by bank transfer, PayPal, credit card and cash on delivery (the latter intended exclusively for Italy).
For other forms of payment, please contact the company directly. In all cases, delivery will not be made until confirmation of payment has been received.
2.3 The total cost of shipping and transport, in Italy and to other European Union countries, as far as the customer's home, is totally to the charge of the supplier when payment is made by bank transfer, credit card or PayPal. In the case of the purchaser opting to purchase by C.O.D. (Italy only), it shall be charged the tax shown on the last page of payment before the customer enters its details.
3. METHODS OF PAYMENT
3.1 The customer can choose between different payment methods:
* ONLINE PAYMENT by CREDIT CARD
Accepted cards: Visa, Mastercard, PayPal prepaid Card, Discover, American Express, Carta Aura. The payment is verified instantly by the bank and the order is immediately processed.
* ONLINE PAYMENT with PAYPAL
Payment is verified instantly by the Paypal system and the order is immediately processed.
* ONLINE PAYMENT by BANK TRANSFER
In this case, the order will be executed upon receipt of confirmation from the bank that payment has been made. When this method is chosen, appropriate checks have to be made and the processing and order management time could be longer.
* CASH ON DELIVERY (Italy only).
4.1 The purchased goods will be delivered within the terms indicated in article 54 of Legislative Decree no. 205/06.
The expected delivery times, both for Italy and for other European Union countries, are
1 or 2 workdays. Delivery times and dates may vary due to uncontrollable external factors. The company disclaims all liability for late delivery caused by force majeure.
5. ORDERING GOODS ONLINE AND PRODUCT AVAILABILITY
5.1 The Customer ensures that all the information required when ordering the goods
online are accurate and complete in all respects and that such information pertains
to the customer and/or the person issuing the order and not to any third party.
5.2 The customer may purchase the items indicated in the electronic catalogue prepared by
www.forbicipercapellielio.it in the quantities or numbers available in stock. For this
reason, in the case of the product purchased by the customer no longer being in stock and not otherwise available within the terms indicated in art. 54 Legislative Decree no. 205/06,
the company undertakes (following written notice pursuant to art. 54 Leg. Decree 205/06, sub-section II) to refund just as quickly as possible (and in any case within at most 30 days) the value of the transaction and not the costs incurred for the payment of the supply.
6. LIABILITY AND PRIVACY
6.1 The Company disclaims all liability for problems attributable to force majeure such as, by way of example, accidents, explosions, fires, strikes, earthquakes, floods and similar events that could prevent execution, in whole or in part, within the times agreed in the contract.
6.2 The company shall not be liable for any fraudulent or illegal use that may be made by a third party of credit cards and other means of payment, at the time of payment of the purchased products; at no time in fact during the purchase procedure is it able to know the customer's credit card number which, by opening a protected connection, is sent directly to the provider of the banking service.
6.3 The company carefully abides by the procedures required by Directive 95/46/EU as
transposed by Leg. Decree no. 196 dated 30 June, 2003 for the processing of personal data and, for the protection of consumers with respect to distance contracts, Directive 97/7/EC as
transposed by Leg. Decree no. 185 dated 22 May 1999.
6.4 The customer declares having read the information provided, pursuant to art. 10 L.
675/1996, at the time of filling out the online forms needed to complete purchases and that these data will be used for purposes strictly related and instrumental to the management of relations with the party completing such forms (internal statistics, satisfaction feedback,
preliminary acquisition of information aimed at entering into a contract or providing a service, etc.) and purposes connected with obligations required by applicable laws.
7. CUSTOMER'S OBLIGATIONS
7.1 The customer agrees and undertakes, once the online purchase procedure has terminated, to print and file the present general conditions which, furthermore, it shall have read and accepted as a mandatory purchase step, as well as the specifications of the product being purchased, in order to fully satisfy the condition laid down in Art. 52 and 53 of Legislative Decree no. 205/06.
7.2 It is strictly forbidden for the customer to enter false and/or invented and/or fantasy data in the registration procedure required to start the procedure for the execution of
this contract and related subsequent communications: the personal data and email must be the real ones of the customer only and not those of third parties, or invented.
7.3 Entering data of third parties is expressly forbidden. The company reserves the right to pursue any violation or abuse through legal channels, in the interest and for the protection of consumers.
8. WARRANTY CERTIFICATE
PURPOSE OF WARRANTY
The 'Elio' scissors are covered by the Seller's warranty against any manufacturing defects.
The warranty covers the purchase of the 'Elio' scissors made through the Seller and
consists in the free of charge replacement or repair of defective parts and which have been ascertained as such by the Seller or by persons acting on its behalf. The Buyer undertakes to notify the functional fault to the Seller's address and directly agree the repair procedures or any replacement of the scissors with the latter.
The warranty period is set at three years. The warranty period starts from the date of
issuance of the warranty certificate.
The warranty does not cover the following: use of product for unintended purposes; damage caused by failure to abide by the operating, maintenance and cleaning instructions, indicated at the time of sale by the Seller; damage to the scissors or individual parts thereof resulting from disassembly, handling and changes made by the Buyer without the express permission of the Seller.
9. RIGHT OF WITHDRAWAL AND CLAIMS
Information on the right of withdrawal pursuant to art. 49, sub-section 4, Consumer Code
The consumer has the right to terminate the product purchase contract without being required to motivate such decision, within 14 days from receipt of the product.
To exercise the right of withdrawal, the consumer must inform the seller of its decision to withdraw from the product purchase contract by means of express notification, to be sent within the aforementioned period of 14 days by registered mail with recorded delivery to the seller's registered office or by certified email. The consumer must return the product, always within the period of 14 days from the date of dispatch of the notice of withdrawal.
An essential condition for exercising the right of withdrawal is the substantial integrity of the product to be returned. The seller shall refund to the consumer all payments made, without any undue delay and in any case no later than 14 days from when the seller receives the product from the consumer.
Such refunds shall be made using the same means of payment used by the consumer for the initial transaction, unless the parties agree otherwise. The right of withdrawal shall not apply in the case of the purchase being made by an entity registered for V.A.T. (non consumer).
